Terms of sale
The terms that apply when you buy from ARCAVELLE.
Who we are
This website, arcavelle.shop, is operated by Show Pony Group Pty Ltd (ACN 156 041 913, ABN 30 156 041 913), an Australian private company, trading as ARCAVELLE (“we”, “us”), New South Wales 2017, Australia. These terms apply to every order placed on this website by consumers. Please read them, together with our delivery, returns and privacy pages, before you order.
Who can order
You must be at least 18 years old, or have the consent of a parent or guardian, and have a delivery address in one of the countries listed on our delivery page. Our products are sold for private use.
Products and descriptions
We sell barrel-leg jeans, barrel trousers, fitted tops, leather belts and curved shoulder bags. Each product page states the arc, fit, reference measurements, material, details, colour and care. Photographs show the product as accurately as we can; colours vary slightly between screens. Photos may show other items (for example a top, belt, bag or shoes worn with a pair of jeans) that are not part of the product and are sold separately. The arc in degrees is our own measurement of the curve of the outer seam, explained on Fit, sizes & arc.
The exact fibre composition of each piece is printed on its sewn-in label. If you need it before ordering, email us and we will confirm it.
Prices and currency
- Products are priced in US dollars. If you choose another currency (EUR, GBP, DKK, SEK, NOK or CHF), we convert prices at fixed exchange rates that we set and update from time to time, and we round them. The currency and amount shown at checkout are the currency and amount we charge. Your bank may charge its own fees if your card is in a different currency.
- Orders are exported from Australia, so no Australian GST is added. Import VAT, duties and carrier fees in your country are not included and are paid by you on import (see Delivery & import charges).
- Shipping costs are shown on every product page and again at checkout, before you pay. We do not add any other fees.
- If we make an obvious pricing error, we will tell you and give you the choice of continuing at the correct price or cancelling for a full refund.
How the contract is made
- You add products to your bag, enter your details, choose a shipping method and review the order summary. You can correct any input before ordering.
- When you click Place order and pay, you make a binding offer to buy the products and authorise the payment.
- We send an order confirmation email. The contract is concluded when we send it.
- If we cannot accept your order (for example, a product is no longer available or we cannot ship to your address), we tell you and refund any payment in full within 14 days.
The contract is concluded in English. Translations of this website are provided for convenience; where they differ, the English version prevails, without affecting any mandatory consumer right you have under the law of your country. We store your order, and you can see it in the confirmation email and, if you have one, in your account.
Payment
You pay when you place the order, using one of the payment methods shown at checkout. Payments are processed by a PCI DSS-compliant payment service provider over an encrypted (TLS) connection; we never see or store your full card number. Your statement will show ARCAVELLE. We may cancel an order and refund it in full if the payment provider flags it as fraudulent.
Delivery
We ship from Australia to the countries listed on our delivery page, normally dispatching within 1–3 business days. Delivery times are estimates. If we have not delivered within 30 days of the contract, or a later date we agreed, you may cancel and receive a full refund. Risk in the goods passes to you when they are delivered to you or to a person you named.
Cancellation, returns and withdrawal
You can cancel free of charge until the order is dispatched. After delivery, our 30-day returns promise applies, and if you live in the EU, the UK or the EEA you also have a 14-day statutory right of withdrawal, which you can exercise online using Withdraw from contract here. Both are explained on our returns page, which forms part of these terms.
Consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or under the mandatory consumer-protection rules of the country where you live. In the EU this includes a legal guarantee of conformity of at least two years from delivery.
Liability
Subject to your rights above, we are responsible for loss or damage you suffer that is a reasonably foreseeable result of our breach of these terms or our negligence. We are not responsible for business losses, because our products are sold for private use. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
Promotions
We are not running any promotions, discount codes, free gifts or trials. If we do in future, their conditions will be shown next to the offer and at checkout before you agree to them. The “Arc + Line” outfits on our pages are styling suggestions: each item is added to the bag on its own at its normal price, without a bundle discount.
Intellectual property
The designs, photographs, texts and the ARCAVELLE name and mark on this website belong to Show Pony Group Pty Ltd. You may not reproduce them commercially without our permission.
If something goes wrong
Contact us first at support@arcavelle.shop. We reply within one business day and will try to resolve the problem directly.
If we cannot resolve it, consumers can contact NSW Fair Trading, which handles complaints about businesses in New South Wales, or the consumer advice body in their own country (in the EU, the European Consumer Centres Network helps with cross-border purchases; in the UK, Citizens Advice). We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.
Governing law and jurisdiction
These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction. Nothing in this clause affects your right, as a consumer, to rely on the mandatory consumer-protection rules of the country where you live or to bring proceedings in the courts of that country.
Changes to these terms
We may update these terms. The version on the website when you place your order applies to that order.
